Abstract (EN)

In our thesis, we have tried to explain the transfer of a commercial enterprise in the provisions of the Turkish Commercial Code, the Turkish Code of Obligations and the Turkish Code of Enforcement and Bankruptcy, which are the fundamental laws of Turkish law, and the prospects of these laws and the regulations they bring. We have tried to assess the provisions of the relevant laws in order to ensure uniformity and harmony both in their own regulations and in the overall scope of application of the transfer of the commercial enterprise institution and in the relationships between them. In this context, we have divided our thesis into four chapters. In the first chapter, we explained the concept of a commercial enterprise. In the second chapter, we examined the transfer of commercial enterprises from the perspective of the Turkish Commercial Code. Then we examined the transfer of commercial enterprises, in the third chapter from the point of view of the Turkish Code of Obligations, and finally in the last chapter we examined this from the point of view of the Turkish Code of Enforcement and Bankruptcy.
