Abstract (EN)
In this study has been examined, the issue of Unregistered Acquisition of Real Estate Property in Turkish and Azerbaijani Law. The first part of the study is the obligation of registration in the acquisition of real estate property and the need to make an exception to this. In this context, the necessity of registration of real estates, the land registry system, registration and its exceptions were examined. In the second and third parts of the study were examined, the cases of unregistered acquisition of real estate property. In the second part, the cases of unregistered acquisition, which are stipulated in the Turkish Civil Code and the Azerbaijan Civil Code, were discussed in detail. Again in this section, the cases of unregistered acquisition, which are not regulated under the Civil Code, were elucidated. And also in the third part, which is devoted to the acquisition of real estate ownership by statute of limitations, the acquisition of real estate property with ordinary and extraordinary statute of limitations has been mutually examined and evaluated in terms of the Civil Code and the Civil Law.
