Abstract (EN)
As a new form of slavery, human trafficking is to commoditise of humans by taking their fundemantal rights and freedoms away. Human trafficking which presents a major danger towards humanity is being committed even more as time goes by. That is why i decided to study on human trafficking by analyzing the background and definition of crime of human trafficking from different aspects in international law also comparing to Turkish and Azerbaijan criminal law. In this thesis, i also tried to demonstrate rate of increase of crime of human trafficking, intention of committing this crime, percentage of female, male and child victims by means of international reports and last statistical data given by Republic of Turkey and Azerbaijan. Meanwhile the elements of this crime is discoursed comparatively among different approaches in doctrine towards mostly the object of this crime, related Supreme Court practice, Azerbaijani Assize Court practice and European Court of Human Rights' judgments. As a result of the efforts made, related judgments are added to this thesis. The most favorable definition of crime of human trafficking which is made in Protocol to Prevent, Suppress and Punish Trafficking in Persons Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime namely Palermo Protocol is mentioned in this thesis. Moreover the different definitions on human trafficking are analyzed by comparing between Turkish Criminal Code numbered 5237 and ACCM numbered 787-IG, also analyzed how compatible these definitions are.
