Abstract (EN)

In this study, we will investigate the crime of forgery in official documents which is one of offenses committed againist the public confidence and regulated in the article 204 of Turkish Penal Code numbered 5237. In this thesis, on the one hand, the theoretical information about the accorrence of crimes is explained on the other hand, to make the understanding of crime much easier, high court decisions, different perspectives in the doctrines and curent developments have been analysed. We have also mentioned about the different and similar aspects of offense as issued in the abolished Turkish Penal Code numbered 765. The forgery of official documants necessitates technical information and it has become more complicated with the developing technology. Therefore, our purpose in this study is to find solutions to the problems and hesitations about the offences of fraud in the official documents. Our thesis consists of 3 sections. In the first; we have focused on the general information crime, especially the term forgery, common features of offenses of forgery, the document, the elements of decument and the types of documentation. In the second section; we have explained the material elements of crime and moral element of crime, qualified forms of crime and the unlawfulness element of crime. In the third section; we have mentioned special forms of crime, information about the criminal procedure law and some spesific cases. Finally, we have concluded the thesis, revealing the results of this study. Key words : Forgery, Public Confidence, The document, The Official Document, Turkish Penal Code.
