Abstract (EN)
With the development it has shown from the past to the present, nuclear energy has started to take its place as one of the main actors representing the level of development and power among states. While nuclear energy is one of the environmentally friendly energy types under normal conditions, since the extent of environmental pollution in the event of an accident is higher than other energy types, its advantages and disadvantages can be high depending on the type of use. There are studies in the literature regarding compensation law regarding liabilities in the event of a nuclear accident, and according to our study, which was created with the belief that there is a gap in the literature in basing the punishment, which is the last resort according to the universal principle of criminal law, on a legal basis, the determination of faults and liabilities is important in determining the criminal liability of the nuclear power plant operator due to the accident. Therefore, it has become necessary to examine the international and national regulations regarding criminal liabilities in the cross-border effects of nuclear accidents. Since nuclear power plant accidents affect large geographical areas for long periods of time, it is difficult to determine the causal link. In our study, it is mentioned that criminal liability cannot be reached solely with the knowledge and experience of the judge without using different positive science branches in the trial. In the examination made in accordance with Articles 172, 173, 174 of the Turkish Penal Code, the Nuclear Regulation Code and other types of crimes regulated in accordance with the Turkish Penal Code were mentioned and the criminal liability regarding the dangers and damages that accidents occurring in nuclear power plants may cause to the environment, health, life and property of others was examined. Within the scope of our study, general works related to positive sciences outside the scope of legal works have been examined and evaluated cumulatively with current data. General conclusions have been reached based on the information obtained through source reviews and numerical data.
