The crime of calumny in the Turkish Penal Code

The subject of our thesis is the crime of slander which is regulated in article 267 of the Turkish Panel Code No.5237. Our study aims to reveal the scope of the crime of slander, what the acts included in this scope are, by making use of both doctrine and judicial jurisprudence. In our study, first of all the elements of crime of slander were determined. Which actions are related to this crime is analyzed with this method. In addition, it is mentioned what are the differences between the crime of slander and other similar offenses. As the number of studies about the crime of slander is limited, it is benefited from jurisprudence. With these methods, the controversial matters related to crime of calumny is stated. It is aimed to find solutions regarding the law by adding our opinions of the writers and the applicable decisions. The cancellation decisions given by the supreme court related to law of calumny are analyzed in sections and tried to give guidance to legislators with new regulations.
