Probation in Turkish Law

In this piece of work which studies probation in Turkish law system, by mentioning the main principles of the system and how they are carried out , the problems considering the present state have been underlined and with the help of evaluating the solutions which could help overcome the problems,the main aim has been to make suggestions. Priority has been given to the explanations about the concept of probation and its quality considering law and this has been an introduction to the subject and in the following parts, the applications of probation in comparative law have been evaluated in chronological order. As probation do not haveits roots in our country's law system, , the legislation and the applications in the countries where probation have appeared and carried out have stated and how Turkish law system benefits from this application and how it could benefit from it in the future have been detected. It was only possible in 2005 that the institution under the name probation was able to have a place in Turkish law system. The applications which have been similar to probation in our early criminal legislation have been examined to have an opinion about the legal foundation and the tendency which has been observed to adopt restorative criminal justice in our system of law. The organization of the institution that has been accepted have been stated and suggestions have been made. By giving information about the present criminal legislation and applications considering probation, the duties of the institutions responsible from probation have been expressed and the importance of probation service has been emphasized. As a result, by evaluating the probation system of the country in general tens have been made to improve the system.
