Abstract (EN)
Our working topic is "Franchising Contract in Turkish Law". The fact that the definition and elements of the franchising contract are not regulated in the Turkish Code of Obligations and other laws, the number of charge contained in the franchising contract is very large and these actions differ in concrete relationships leads to a number of legal problems. For this reason, the need of examining the franchising contract in terms of its legal nature, elements, rights and obligations that the parties have as a result of the contract, and the reasons and consequences of the termination of the contract has occurred. Our work consists of four main parts. in the first section, in order to better understand the franchise contract, the concept of the franchise was explained and the definition of the franchise contract was made and its historical development was mentioned. In the second part of our study, the legal nature of the franchising contract was focused on. The form of the franchising contract is mentioned and its elements are described. Subsequently, a detailed comparison of the franchising contract with similar contracts was made. In the third part of our study, the obligations of the parties in the franchising contract are explained in the light of the provisions applied in Turkish legal legislation and comparable provisions and the decisions of the Court Of Cassation. In the last part of our study, titled "Reasons for the Termination of the Franchise Contract and the Consequences of the Termination", the causes of the termination of the franchise contract and the consequences of this termination situation were focused on.
