Abstract (EN)
The concept of trademark can be described as a sign used in trade, which has a distinctive element and helps to distinguish the goods or services of a business enterprise from the goods or services of other business enterprises. Registration of a trademark for legal protection is necessary, but not mandatory. In this study, the concept of trademark in general, the distinction between registered and unregistered trademarks, the rights of the owner of an unregistered trademark to object and sue against other trademarks will be discussed, and the rights of the owner of an unregistered trademark within the scope of special and general provisions will be discussed.
