Abstract (EN)
The subject of this study is the comparison of German and Turkish administrative procedure law systems regarding judicial protection provided to citizens in cases when the administration does not fulfil their subjective public rights. As the method of the comparison, the position, function and the fields of application of the action for obligation in German law are primarily explained. Then the instruments in Turkish law which are applied for fulfilling the same purposes are compared with the action for obligation in German law. After that, a comparative evaluation between two administrative procedure law systems is carried out. As the result of this evaluation, opinions about improving the effectiveness of the administrative judiciary with respect to the administrative judgement process and the enforcement of court decisions in Turkish law have been presented.
