Abstract (EN)

The substitution of motives is a concept that has come to the fore with its practical aspect and is born with the aim of saving time and procedure, and it is an authority that gives an unfair result and exceeds if its conditions are not fully fulfilled. For this reason, a number of questions about the nature of the substitution of cause and application conditions are waiting to be answered. In this study, the substitution of motives for the legal causes of the administrative process will be discussed, after the reason element is examined in terms of the general administrative law theory, the historical background in the case of substitution, the conditions of substitution with the application and the issues that may be considered problematic in this context will be discussed.
