Abstract (EN)

In our country, during the period of Republic, the Auction and Tender Act numbered 2490, Awarding Act numbered 2886 and Public Awarding Act numbered 4734 became effective in order of being effective. In addition, Public Procurement Contracts Law numbered 4735 also became effective in order to regulate the public procurement contracts. Because some provisions of the act numbered 2490 contained some detailed regulations causing loss of time, State Awarding Act numbered 2886 became effective. Then, Public Awarding Act numbered 4734 became effective because the State Awarding Act numbered 2886 was not efficient enough on transparancy, its regulation of auction was irregular and it couldn?t follow the current proceedings on the world. With some regulations introduced by this act, performing the topics of auctions became more controllable and more suitable to be monitored. It is of great importance to provide transparancy and clarity in public auction procedures in our days in which efficiency has gained great importance in public spendings. Lawlesness and irregularity in public auctions lead to misuse of public sources and abuses. Turkish auction system has been continuously updated in order to be more effective in such subjects and especially, legal regulations are rapidly being effective in process of adaptation to European Union.
