The best interests of the child in the Turkish Civil Code

The principle of the best interests of the child which is the cornerstone of child law, has found its place in many international scripts, especially the United Nations Convention on the Rights of the Child. According to this principle, child's benefits will be observed and protected in all actions and take precedence of all types of other benefits regarding childrens Since child law is a mixed branch of law that contain both private and public law, the principle of the best interests of the child finds application in private and public law. The principle of the best interests of the child is not an independent principle from the rights of the child and the provisions of the law concerning the child. On the other hand, the principle of the best interests of the child is "umbrella principle"that should be observed in the implementation of other child-related principles.Therefore, child law is shaped within the framework of the principle of the best interests of the child. The principle of the best interests of the child is included in the provisions of the Turkish Civil Code concerning the child. Along with the Turkish Civil Code, also high judicial bodies make judgments by considering the principle of the best interests of the child In our study, the appearance of the principle of the best interests of the child in the Turkish Civil Code examined.
