The legal regime of foreigners of Turkish origin

In the legislation, it is seen that some foreigners are given privileges compared to other foreigners. Foreigners of Turkish origin are also one of the privileged foreign groups. Foreigners who will be included in the scope of Turkish origin foreigners are not regulated precisely and clearly in the legislation. The meaning of the concept has been tried to be determined by examining the views put forward in the doctrine and in practice in terms of people who will be included in the scope of foreigners of Turkish origin. Since people who are accepted as immigrants in accordance with the Settlement Law are of Turkish descent and bound with Turkish culture, the opportunities and privileges granted to immigrants are included in the scope of our study. The Settlement Law and the Turkish Citizenship Law contain regulations regarding the naturalization of immigrants. Because two different regulations on the same subject are in force at the same time, it is seen that there is confusion about how to implement the application. This problem has been tried to examine in the context of the views put forward in the doctrine regarding the conditions under which both regulations will be implemented. In addition, issues related to the naturalization of foreigners of Turkish origin in the previous regulations were examined by comparing them with the new regulations. It is also seen that there are special regulations for the naturalization of foreigners of Turkish origin, such as citizens of the Turkish Republic of Northern Cyprus and Meskhetian Turks. Opportunities of foreigners of Turkish origin in terms of the right and freedom to work is one of the most privileged issues for foreigners of Turkish origin compared to other foreigners. Foreigners of Turkish origin were given the opportunity to practice professions and arts reserved for Turkish citizens with a special law brought for them. Foreigners of Turkish origin are the only group of foreigners who could work as civil servants in Turkey. In our study, it has been tried to put forward the conditions for the foreigners of Turkish origin to work in Turkey and the principles regarding their work. Moreover, other privileges granted to foreigners of Turkish origin and regulations in this regard have been examined.
