Abstract (EN)
In the second part of the study; Of disaster management organization in Turkey are discussed development in the sense of historical and legal, that is considered a turning point in our disaster management system in the 1999 Marmara earthquake before and after the period is considered as a comparative institutional structure of the existing disaster management in our country.In the third part of the study, the evaluation of the disasters within the scope of responsibility principle of the administration, conditions, types of responsibility and responsibility of the administration and the principle of responsibility and how this responsibility should be handled and applied in disasters were made. In this part of the study, the responsibility of the administration is discussed in detail under four headings under the Law No. 6306 on the Transformation of Disaster Risk Areas and in the context of force majeure and unexpected situations.Both within the scope of the Law No. 6306 on the Transformation of Disaster Risk Areas and in the context of the force majeure and unexpected circumstances, the responsibility of the administration was not considered before, but in recent years, especially after the 1999 Marmara earthquake, nature-related disasters were not accepted as force majeure. in the context of national and international law in the context of the right to life and property rights.In the conclusion part of the thesis; The legal and administrative arrangements envisaged in the disaster management system in our country, measures to be taken before the disaster, development and efficiency of the disaster management system in our country and how the responsibility of the administration for the disaster should be handled, determination, evaluation and suggestions are given.
