Turkey shall be attempted: The example of KESK

Entitling freedom of organization to all sections of society and providing constitutional guarantee for these rights are amongst the basic principles accepted by countries those adopt principles of social law state and democratic constitutional state. Freedom of organization has an important function in reliable running of participatory democratic system. Freedom of organization is necessary for an environment, where working section in society could state their problems, convey their desires, express themselves more powerful in every aspect, and duties of the state for working section are reminded. Countries which freedom of organization has been entitled and established in, shall be both obliged to fulfilment of the necessities of social state, and perform the state of law principle of treat impartial and equally to every section.The most important organization form for working section are labour unions. When development of unionism movements all over the world are observed, it is seen that unionism movements are established in national and international aspect, and unionism has been an important topic in agenda with the beginning of 20th century. In Turkey, as the current state of entitlement of unionism and freedom of organization, labourer?s liberties are entitled to a great extent. On the other hand, entitlement of government officials? freedom of organisation has always been a matter of reservation. But, in a memorandum issued ,it is stated that constitutional and other arrangements about labour organisations of all working sections, including officials, has been acknowledged and therefore worldwide applied contemporary perspective has been legally converged.In the thesis it was discussed that the historical evolution of ?official?concept in Turkey, its content, and how it is being evaluated on legal aspect. The limitations of official organisation in Turkey, which is one of the basic assertions of the study, were attempted to be explained over the example of KESK (Kamu Emekçileri Sendikaları Konfederasyonu ? Confederation of Public Workers' Unions). Especially, refusal of the right to strike for official organisation and government?s determination on working conditions bring forward the question of how much it is performed of these structures, which are formed to protect the employees, carry out their purposes. In the extent of this question, the situation of official unionism in Turkey shall be attempted to be explained.
