A partial legislative power to the executive branch at the neoliberal authoritarian state building process in Turkey: Presidential decree

In Turkey, by constitutional amendment in 2017 it was abandoned parliamentary system. The President, who forms the executive branch in the new government system, occupies a central position. One of the important powers given to the President is to be able to issue Presidential decrees. This study focuses on Presidential decrees in the context of the principle of separation of powers, the authoritarianism of the state and its tendency to strengthen the executive. In that context the principle of separation of powers, government systems and the evolution of the system of government in Turkey were examined. Then, the authoritarianization of the state and the regulatory power of the executive were discussed. Finally, the ordinary Presidential decrees and the Statutory Presidential decrees issued after the declaration of the state of emergency are interpreted in detail under two headings.
