Abstract (EN)

Technological advances that make rapid progress today, on the one hand, enable more effective use of human rights, and on the other hand, cause many problems related to human rights. With the opportunities offered by technological developments, communication, education, health, law, etc. While some conveniences are obtained in areas and in daily life, at the same time, information about our life and who we are is recorded at every step taken. Moreover, it is more important that smart devices are used more, data usage increases, and as a natural result of these uses, technologies equipped with artificial intelligence, which have the capacity to process these data, are included in our lives at the same speed. With the use of computer systems and the internet, which have become more common with the developments in communication technologies, data has begun to be processed, transmitted, used and stored very quickly, which reduces the rate of people controlling their own information. With the increase in the violations of rights related to personal data, it has become necessary to make some regulations regarding the security of personal data, both nationally and internationally. The right to the security of personal data, which is directly related to fundamental rights and freedoms, is very important in terms of the development of international human rights and the rule of law. The security of personal data is aimed at enabling the free development and protection of the personality, as well as protecting the fundamental rights and freedoms offered by international human rights. For this reason, the security of personal data, which is a very current and important issue today, constitutes a national and international problem area waiting to be solved. In this study, whether the security of personal data is accepted as a fundamental right and its relationship with international human rights will be discussed. The aim of this study; is to make understandable the importance of the need to protect the security of personal data nationally and internationally. In the light of this purpose, within the framework of the thesis, it is revealed that personal data security is related to the way it is regulated in the literature, together with fundamental rights and freedoms in the context of international human rights.
