Abstract (EN)
International protection implies the protection system built-in international law for people who are forced to flee from their country of origin or country of residence in case of statelessness based upon well-founded fear and who will likely suffer serious violations of human rights. Temporary protection implies the protection mechanism built for people who seek asylum in another country in mass influx situations based upon widespread violence and conflict. One of the most important elements for people who have these statutes to sustain their lives in an honorable way is the right to work. The aim of the study you hold is to clarify the rules made in the subject of these people's access to the right to work in Turkey. In this direction, firstly, the framework in international law is put forward by the reason that it is the source of the rules in Turkish law. At this point, with the 1951 Geneva Convention Relating to the Status of Refugees being in the first place, the rules generated by the United Nations are examined alongside the rules built in the European system which includes the ones within European Union. After, the rules that are in the Constitution, Aliens and International Protection Law, International Labour-Force Law, Regulations on Employment of International Protection Applicants and International Protection Status Owners, Regulations on Employment of Aliens Provided Temporary Protection are examined through paying attention to the effects of the rules in international law.
