Abstract (EN)
The meaning, scope, and implementation of the overriding public interest included in the judicial decisions as a concept that enables to evaluate between competing or conflicting public interests have been addressed within the scope of the study. In this context, the table exhibited by making a grouping based on the justifications of the judicial decisions in order to show the approach regarding the determination and detection of the overriding public interest has been discussed by utilizing doctrinal views in terms of legislation and theoretical dimensions of the subject.
