Drug or stimulant trafficking crimes

It is a well-known fact that drugs or stimulants are no longer a national problem, but have gained an international identity. Since these substances pose many risks to the welfare of the people of the world, countries have enacted laws and tried to take measures within their own bodies. Although this issue is also valid for our country, illegal use and trade of drugs and stimulants cannot be prevented. On the contrary, crimes related to the manufacture, trade and use of these substances and aftershocks caused by this act cannot be prevented. Crimes related to drugs and stimulants and the penalties given for these crimes are regulated in articles 188, 190 and 191 of the Turkish Penal Code. The production and trade of drugs and stimulants, facilitation of the use of these substances, taking or keeping drugs or stimulants without any commercial purpose are defined as crimes. In addition, Article 189 of the Law provides for the application of security measures to legal entities, and Article 192 regulates effective repentance for drug and stimulant crimes. This study evaluates the Turkish Penal Code together with other laws, regulations and international conventions enacted in order to effectively fight drugs or stimulants. The Supreme Court decisions were also included in this study in order to demonstrate the implementation of the aforementioned rules and to shed light on some issues where unity could not be achieved in practice.
