Abstract (EN)
While foundations and associations are similar in adopting the ideal aim, they are quite different in terms of legal structures. However, the founders include the membership in the deed of foundation like a association. This is criticized unanimously in the doctrine, but in practice it is not mentioned how these structures that allowed by the court and the supervisory authority will function. Upon the annulment of the ban on foundation membership regulated by Turkish Civil Code (TCC) Art. 101 paragraph 3 with the decision of the Constitutional Court, it became necessary to resolve the legal issue in question.
