Shift working system and its place in Turkish work laws

In the daily life, the dark part of the day is considered to be for some peopleas a partly working time and for some people as a whole working period. Especially,industrial needs forced people to work in that period. Recent researches proves thatthere is an increase of companies who adapts shiftwork.Beside the fact that shift working in today?s job environment is widespread,the shift working system has to be considered separate from daytime shifts due tothe fact that their conditions are more severe, exhausting and wearing than daylightwork.As a matter of fact, not only in some agreements and recommendations ofInternational Labour Organizations but also in the Labour Law, we can see thatcertain new regulations are being designed in order to protect night shift workers.This study entitled ?Shift-working and its position in the Labour Law?consists of two parts.In the first part, shift-working is defined, and for this reason the economical,social and socio-politic grounds have been analysed in order to present the place ofnight-shifts in work life.Furthermore, the problems which arise from the shift-working from the pointsof view of both the workers and the employers have been considered.In the second part, the arrangement of shift-working in the Turkish Labour Law interms of time, persons and shifts have been analysed first and then both the arrangementson the same agreements and recommendations in the Turkish Labour Law and theInternational Labour Organization have been stated.Finally, legal and penal sanctions for violation of these regulations have beenexplained. In the Implications, the study has been evaluated in general and comments andrecommendations have been considered.Key Words: Shift Working, Night Work, Capacity Increasing.
