Field of application of the Vienna Convention on the sale of goods and the concept of material breach under the treaty

Due to the increasement in commercial relations between states, it is very important for both traders and lawyers to determine which legal rule will be used in the resolution of disputes arising within the scope of these contracts, as well as the establishment and the provisions contained in the sales contracts, which are the cornerstone of the commercial relationship. United Nations Convention on Contracts for the International Sale of Goods - Vienna Convention on the Sale of Goods (CISG) has been prepared by the United Nations International Commercial Law Commission, which was established in order to resolve the question marks regarding the law to be applied in the settlement of disputes arising from international sales contracts and to resolve disputes arising from international sales contracts by applying the same rules in different countries. As of December 2021, 94 countries with different legal systems are party to the Treaty. In general, the Treaty contains very practical provisions regarding the rights of both the buyer and the seller in case of fundamental violation and as such, it is an international law of obligations. In this study, first of all, the application area of the Treaty will be discussed, and the concept of fundamental violation and the main cases of fundamental violations will be examined within the scope of the Treaty, since the provisions contained in the contracts for the international sale of goods are important for both Turkish Law and international law systems.
