Crime and punishment in Ayintâb in the second half of the XVI. century

The court registration which were kept in the settlements within the borders of the Ottoman Empire, are very important records for understanding the social structure and regional life. There are alsocourt registrationin Ayıntâb, which was annexed to the Ottoman Empire in 1516. In order to work within the scope of the thesis prepared, the records in Ayıntâb were preferred in the second half of the XVI century. Of the six books that were studied, the records that were kept for the purpose of committing a crime or claiming to have committed a crime were obtained. Within the Islamic law on which the Ottoman Empire was based, punishments for crimes committed were determined by adhering to certain conditions. Crimes are generally divided into crimes requiring hadd punishment, crimes requiring short and diet punishment, and crimes requiring ta'zir punishment. Precisely defined the borders of the rights of Allah and the punishment of Hadd for the crime of killing or wounding people in justice and penalties erroneously or deliberately diet to take rights from each other, taz'ir punishment for crimes unspecified penalty are punishment. The crimes in which these punishments are applied, which have been distinguished in Islamic law, were selected from the books studied and evaluated by classifying them as titles and tried to be explained as much as possible. With this assessment, the crimes committed in Ayıntâb in the second half of the XVI century were tried to be understood. In this period, the events encountered in family and community life and their reflections on family and society were examined and tried to make a small contribution to the field.
