Abstract (EN)

The use of social media where people can share photos and texts for free almost everywhere in the world extinguished the data scarcity, which was an obstacle in front of machine learning technologies. Thus today, machine learning has become more achievable and thriving with the disappearance of data scarcity and the developing computing power. By this way, artificial intelligence (AI) has reached a capacity that will enable it to be used in almost all areas of life. For this reason, it is necessary to be ready for the social, economic, and legal consequences of AI, which makes itself known in almost every field of life in the 21st century. Patent law is one of the areas in which AI causes uncertainties. Accordingly, the first part of this thesis focuses on the concept of AI and its relationship with intellectual property law. In the second part, problems caused by inventive AI in current patent law systems are discussed within the framework of Turkish, English, and U.S. laws. Finally, in the third part, the AI- generated inventions are examined under the scope of the economic analysis of intellectual property law and the values that it protects. Thereafter, the policies that may be adopted against the uncertainties caused by such inventions are elaborated in the light of their advantages and disadvantages.
