Abstract (EN)

This study is a study that examines the historical development of judges and prosecutors' board in the context of judicial independence principle, how the principles constituting judicial independence are applied in democratic countries and the present structure of judges' prosecutors' board after the Constitutional amendment on 16 April. This thesis is to put forward the precautions in the legal system regarding judicial independence of the states regarding the full provision of the judicial independence of the aim and the absence of intervention. The method we will use in our thesis also provides information on the definition of judicial independence in the first chapter and the historical process of how judicial independence principles are applied in contemporary democratic states and in Turkey after examining the historical process. In the second chapter, the historical development of judicial independence in the Turkish legal system has been examined by Kanun-i Esasi until 1982 Constitution. In the third chapter, the restructuring of the Council of Judges and Prosecutors has been examined in terms of the concept of law state and judicial independence of the Supreme Council of Judges and Prosecutors.
