Responsibility of the administration for moral damages in the light of judicial decisions

In this study titled "The Administration's Responsibility for Non-pecuniary Damages", the responsibility of a state that adopts the principle of the rule of law and the social state is mentioned. As a result of this responsibility, the opinions of the Supreme Court and the opinions in the doctrine regarding non-pecuniary damage in the sense of compensation and compensation obligations have been examined. Even though the administration has acted in accordance with the law due to its activities, any damage may have occurred. The responsibility of the administration is mentioned if there is a causal link between the action or operation of the administration in the occurrence of damage. In order for the administration to be held responsible, certain conditions must be met. First of all, there must be an action or transaction carried out by the administration. Damage must have occurred as a result of the action or transaction in question. In addition, there must be a cause-effect relationship between the action or process of the administration and the damage. Damage caused by the administration's actions and operations may cause psychological harm to the person, as well as pain, suffering and suffering. In this case, we can talk about moral damage. Non-pecuniary compensation is important in order to eliminate moral damage even to a certain extent. Moral damage focuses on compensation. There are some issues for awarding non-pecuniary damages.
