Avrupa entegrasyonu sürecinde Avrupa Adalet Divanı'nın rolü: Neofonksitonalist analizi

This thesis evaluates the role of the European Court of Justice (ECJ) in the process of European integration under Neofunctionalism. The main argument of the thesis is that the ECJ, as an autonomous political actor, has successfully influenced the Union's policies, changed the political elites' preferences, and made substantial contributions to creating legal principles to foster and maintain the momentum of European integration under the Neofunctional logic, especially the notion of spillover. Chapter 1 introduces various narratives of the role of the ECJ and the notion of spillover under Neofunctionalism. Neofunctionalism is taken as the primary theoretical framework to analyze the role of ECJ during European integration in this thesis. Chapter 2 offers an overview of the ECJ and assesses the role of the ECJ under a Neofunctionalist analysis. Chapter 3 provides two legal principles elucidated by the ECJ within the integration process: 'the mutual recognition principle' and 'the right to be forgotten.' These principles corroborate that the ECJ produces spillovers to influence European integration. The thesis concludes that the role of the ECJ nicely dovetails with the concept of spillover under Neofunctionalism and that the ECJ produces spillover effects, which have successfully influenced the European Union's policies.

Avrupa bütünleşmesinin katalisti olarak Marshall Planı: Neo-realist temeldeki yeni-işlevselci yapı

In the aftermath of World War II, Europe was suffering from the devastation brought by conflict, together with food shortages and high unemployment. However, the US emerged as a superpower with economic growth that was achieved during the war. Western Europe was about to fall under the threat of another superpower, the Soviet Union. Hence, the Marshall Plan, also known as the European Recovery Program (ERP), was created as a means of revival and cooperation. The thesis aims to analyze how the Marshall Plan affected the post-World War II European integration process until the creation of the European Economic Community (EEC). With a focus on post-war transatlantic relations and coordination, the thesis elucidates how post-war American foreign policy influenced the relations in the European states, especially between Germany and France, focusing on the German problem at that time. The thesis examines the effect of the Marshall Plan on the early European integration through the assumptions of two different theories. In this vein, the beginning of the integration process is examined through a neo-realist lens, while neo-functionalism is applied as a means to provide an interpretation of its progression. The thesis offers a theoretical contribution to the study of US-European relations, including the events revolving around at the start of the Cold War. AB'nin koşulluluk ilkesinin gelişimi: Soğuk savaş dönemi ve sonrası

Avrupa Birliği tarihinde koşulluluk ilkesi oldukça erken dönemlerden beri uygulanmaktadır. Koşulluluk ilkesi, Avrupa Birliği'nin aday ülkelerden üyelik öncesinde gerçekleştirilmesini istediği reformları yerine getirme olarak tanımlanabilmektedir. Koşulluluk ilkesi ilk olarak, Roma Antlaşması'nın üyelik başvurularının değerlendirilmesi başlığı altında ve Avrupa Birliği kurucu antlaşmalarında yer almıştır. Soğuk Savaş'ın bitmesiyle dağılan Sovyet Rusya'dan ayrılan Orta ve Doğu Avrupa ülkelerinin üyelik sürecinde koşulluluk ilkesinin kurumsallaştığı ileri sürülmektedir. 1990'lı yıllarda Avrupa kıtasında jeopolitik değişimler yaşanmıştır. Avrupa Birliği içerisinde Batı Avrupa ile Doğu Avrupa ülkeleri arasındaki gelişmişlik düzeyi farkını ortadan kaldırmak ve Birlik içinde üye ülkeler arasında denge sağlamak için üyelik kriterleri stratejik bir araç olarak görülmüştür. 1993 yılında kabul edilen Kopenhag Kriterleri ile Orta ve Doğu Avrupa ülkelerinin AB normlarına uyum sağlaması hedeflenmiştir. Avrupa Birliği bu yeni jeopolitik çerçevede uluslararası aktörlük seviyesine yükselmiştir. Bu çalışmada, koşulluluk ilkesinin tarihsel değişimi ele alınmıştır. Literatürde AB'nin koşulluluk ilkesinin Soğuk Savaş'ın sona ermesi ile uygulanmaya başladığı yönünde bir eğilim vardır. Ancak AB, kısıtlı da olsa bu ilkeyi çok daha önceden uygulamaya başlamıştır. Kısıtlı biçimlerde uygulanan ilkeler, Kopenhag Kriterleri kadar kapsamlı olmamıştır. Bu çerçevede tezimizde, Orta ve Doğu Avrupa ülkelerine uygulanan Kopenhag Kriterleri ve Soğuk Savaş öncesi uygulanan üyelik kriterleri karşılaştırılmalı olarak ele alınmıştır. Koşulluluk ilkesi tarihçesinde Soğuk Savaş'ın dönüm noktası olduğu bu karşılaştırmalı analizle birlikte ortaya konulmuştur.
