Rusya Federasyonu'nun Orta Asya politikası ve Çarlık ve SSCB dönemi uygulamalarının bu politikalara yansımaları
16. yüzyılın ortalarından itibaren sürekli Rus saldırılarına maruz kalan ve 19. yüzyılın sonunda tamamen Rus ege menliği altına giren Orta Asya bölgesi, 1991 yılında Sovyetler Birliği'nin dağılması sonucu yeniden bağımsızlığına kavuştu. Bölge halkı, Çarlık Rusyası'nın işgalinden önce, Hanlıklar (Buhara Hanlığı, Hive Hanlığı, Hokand Hanlığı) şeklinde örgütlenmiş bir devlet düzeni geliştirmişlerdi. Ekim 1917 'de Rusya'da geçekleştirilen Bolşevik ihtilali 'nin kendine has uygulamaları, bölgede beş ayrı ulusal kimliğin (Kazak, Özbek, Kırgız, Türkmen, Tacik) ortaya çıkmasına sebep oldu. Ancak, Çağdaş ulusal kimlik kavramının temel öğeleri olan ortak dil, din, kültür ve ırk gibi unsurlar dikkate alındığında, Tacikler hariç, diğerlerinin gerçek an lamda bir ulusal kimliği temsil etmedikleri anlaşılmaktadır. Çünkü, yapılan çalışmalar, bunlar arasındaki benzerliklerin farklılıklardan daha çok olduğunu göstermektedir, işte, Çarlık Rusyası ve Sovyetler Birliği dönemlerinde uygulanan emperyalist Rus politikalarının birer sonucu olarak ortaya çıkan bu kimlikler, bu gün birer bağımsız ulus devlet olarak uluslararası sisteme dahil olmuşlardır. Bu çalışmada, Orta Asya'nın Rus egemenliği altına girmeden önceki durumu, bölgeyi Rus egemenliğine sokan tarihi koşullar, Çarlık ve Sovyetler Birliği dönemlerinde Ruslar 'in bölge politikası ve bölgedeki uygulamaları, tarihi bir pers-VI pektifle verildikten sonra, 1991 'den itibaren Rusya Fede rasyonu 'nun oluşturmaya çalıstılı Orta Asya Politikası ele alıncaktır.

This thesis analyzes the process of both the European integration process from the beginning till now and the Turkey- EU relations. It also analyzes the existing situation in the lights of the past and gives knowledge to the readers the developments that had happened throughout this long process. This thesis aims to explore the role of the EU in the settlement of the Cyprus dispute in the light of the UN-led settlement efforts whether it is a failure and targets to fınd out the basic reasons, if it is a failure. The EU membership of the Greek Cypriot-controlled ?Republic of Cyprus?, on behalf of the whole island, has changed the dynamics of the dispute by deepening the island?s economic and political division in favour of the Greek side. Moreover, the settlement proposals of the UN, EU and Turkish side differ in the sense that while the two organizations support a bi-zonal and bi-communal federal state, the Turkish side insists on the recognition of the TRNC in exchange for its unification with the Greek Cypriots. Although the parties? EU integration prospects can contribute to a compromise, illegality of the EU membership of the GCA according to the 1960 system, misperceptions of the EU related to the parties? expectations, partiality and incredibility of the EU policies and ineffectiveness of its policy methods have led the Union?s failure. Relying on official UN and EU documents, on historical and legal facts and on literature works, this thesis reaches to the conclusion that the EU?s success in contributing to a permanent solution in the Cyprus dispute has been very limited contrary to the expectations from it.

In the recent years, rights talk is used within development theory and practice at a frequent rate; under the heading of rights- or human rights-based approaches to development. Although there are significant challenges; the past two decades have witnessed a momentous rise of attention of the multilateral institutions, international organizations, international non-governmental organizations (INGOs) to the approach. The main argument of this thesis is that the implementation of rights-based approaches seriously depends on how the idea is framed. This thesis utilizes framing in the context of the UNDP. By looking at the official policy notes, project documents, concept papers and briefings, this study traces how human rights-based approaches to development are framed within the UNDP.

International community while establishing international mechanisms to prosecute and punish perpetrators of war crimes, crimes against humanity and the crime of genocide assumed that international prosecution would have a deterrent effect on potential perpetrators. Thus, this thesis aims to analyze the extent of contribution by international justice mechanisms to the prevention of grave human rights violations in an ongoing conflict. In other words, this thesis tries to figure out whether the predetermined purpose of deterring future crimes is realized or not by international criminal courts. After examining the scope of international criminal justice system and deterrence theory in criminology literature, a discussion on the applicability of deterrence theory to the international context is provided. The main argument of this thesis is that if an international criminal court gets actively involved in a conflict, it would have deterrent effect on potential perpetrators. In order to test this hypothesis a case study on the conflict in Democratic Republic of Congo and the involvement of International Criminal Court is conducted.
Reform sonrası süreçte Türkiye'de sağlık hakkı üzerinde Avrupa Birliği katılım sürecinin etkisi
Since the initiation of the Health Transformation Programme in 2003 a series of reforms in health and social security systems have been realized in Turkey. An examination of the official documents related to these reforms in light of the international right to health documents reveals that the former is coherent with the latter, at least ostensibly. Considering the influence of the EU accession process on Turkey as a candidate country, especially in issues concerning human rights, one may expect to see a push from the EU in the issue of health, as well. However, an examination of the EU?s demands in the accession documents concerning the health care system, reveals that EU does not have a strong human rights emphasis in health-related issues, especially before 2003. Interestingly, a right to health sensitivity in the accession documents begins to be observed after 2003, namely the initiation of the Health Transformation Programme. This shows that right to health is not something the EU ignores, but it hesitates to put concrete demands concerning it, be it because of the principle of subsidiarity, or the second class position the Union attributes to economic and social rights vis-a-vis civil and political rights. Whatever the reason is, the question whether the EU accession process has a role in the right to health sensitivity of recent health reforms in Turkey, can be answered negatively based on the accession documents.
Avrupa Birliği?nin Avrupa İnsan Hakları Sözleşmesi?ne taraf olmasının hukuki ve yargısal etkileri
Even though accession to the European Convention on Human Rights (ECHR-Convention) has been on the agenda of the European Union (EU) since the 1970?s; concrete steps to this end has recently been taken in 2010, between the EU and the Council of Europe, and the Draft Accession Agreement was finalized in July 2011. Taking into consideration this Draft text and the related legislative instruments adopted under the auspices of the Council of Europe and the EU; this thesis will try to question whether the Union?s accession to the ECHR will have implications for the legal status and the judicial protection of fundamental rights at the EU level. Accordingly, the research will try to explain the present state of affairs for fundamental rights protection at both the EU and the ECHR level and then will try to analyze whether the accession will have implications for legal status and judicial protection of fundamental rights at the EU level. Relying on the analysis made through the research, this work reaches to the conclusion that the EU?s accession to the Convention will not cause significant changes for the legal status and the judicial protection of fundamental rights at the EU level.
