Disciplinary punishment and measures specified in the Code on Execution of Punishments and Security Measures no 5275

Disciplinary punishments and measures applied to the prisoners and detainees that I have examined in my thesis work are generally regulated in the First Book, Second Chapter, Part 8, in the Code on Execution of Punishments and Security Measures No. 5275. Nature of disciplinary punishments and the circumstances of their implementation are regulated in Article 37 of the Code No. 5275; and disciplinary punishments that may be imposed on detainees and prisoners other than the children and the actions which could lead to the implementation of these punishments are regulated in the articles between 38 and 44. The legislator has foreseen different regulations for child detainees and prisoners. While Article 45 of the Code regulates disciplinary measures that may be imposed on children detainees and prisoners as well as the actions which could lead to the implementation of these measures, Article 46 of the Code also regulates disciplinary punishments that may be imposed on children detainees and prisoners as well as the actions which could lead to the implementation of these sanctions. The following articles include common provisions on disciplinary proceeding, repetition of the actions requiring disciplinary punishment, execution and removal of disciplinary punishments, measures to be taken by the administration, use of compulsory instruments, rewarding, complaints and objections. Definition of execution, historical development and scenes of the execution system, disciplinary punishments that may be imposed on detainees and prisoners other than the children in the Code on Execution of Punishments and Security Measures No. 5275 as well as the disciplinary measures and punishments that can be implemented for child detainees and prisoners have been introduced in my thesis; and then, new opinions have been presented on the relevant issues.
