Abstract (EN)
In 2013, following the coming into force of the Turkish Armed Forces Disciplinary Act No. 6413, indisciplines requiring discharge from the armed forces were collected in a single legislation in terms of military disciplinary law. With the Disciplinary Act No. 6413, penalties such as confinement and probation were abolished except some particular cases, and a military disciplinary law accordant to the understanding of contemporary law was tried to be established. In the first part of our study, the basis of which is constituted by the indisciplines that require the penalty of discharge from the armed forces, the importance of the discipline for the Turkish Armed Forces is mentioned and the reasons for the need of a new Disciplinary Act are examined. Also, in this section, the information about gathering and decison-making procedures of Supreme Disciplinary Committee, which replaced the Supreme Military Council in terms of the decision of discharge from the armed forces is given. In the second part of the study, discipline offenses which come under a single article and require discharge from the armed forces, are examined in the light of court decisions and the views in the doctrine. The discipline punishment point, which was determined as a new dismission method, was also discussed in detail.
