Abstract (EN)
The objective of this study is to examine the right of the agent to request for equalization, which was first legally regulated with Turkish Commercial Code numbered 6102, in detail. Agency is defined as the entity, which operates for marketing of goods and services, produced by client, out of head office as well and which assists merchant without having a legal status dependent on merchant. In the course of the agency agreement, agency markets products and services of client; that way, it builds a circle of customers. The fact that agency will not benefit from this customer portfolio built after expiration of the agency agreement; correspondingly, the client will derive benefit from this circle of customers unilaterally constitute the legal cause of agency?s right of claim for adjustment. Legal character, terms, calculation methods and other properties of the agency's right constitute our thesis subject. According to the conclusion reached in our study, the major conditions for agency to be able to request equalization: the agency agreement?s expiration enables the request for equalization; client can derive significant benefits from the customer portfolio which was built by agency, after expiration of the agreement as well; agency incurs pay loss and the principle of justice requires that the agency be paid equalization compensation.
