Abstract (EN)
Where the creditor, refuses to accept a duly tendered performance by the debtor or fails to carry out the preparatory acts incumbent upon him, without a legitimate reason, the creditor is deemed to be in default. Upon the creditor's default, the debtor is entitled to certain opportunities, some of which are not statutorily regulated, whereas the others are explicitly provided for in the law. This dissertation focuses on the legal character, prerequisites, and termination of the default of the creditor. Furthermore, the legal effects arising from the creditor's default are also analyzed.
