Abstract (EN)

Birth, which is an event specific to women due to their biological structure, is also a physiological risk that occurs in the woman's body. Maternity, on the other hand, is a socio-economic risk due to reasons such as the emergence of new needs during pregnancy and after birth, increased health expenses and a decrease in the woman's work performance. For this reason, women workers need to be specially protected in order to prevent possible negative situations they may experience during pregnancy and after birth. This requirement has made it necessary to legally regulate the rules regarding women's working conditions and social security rights, as well as their protection during pregnancy and after birth. The protection of women who are "mothers" is legally regulated in the Turkish Social Security System, as it is guaranteed in many countries and international legal regulations. The basis of these regulations is the provision in Article 41 of the Constitution of the Republic of Turkey, which states that "The State shall take the necessary measures and establish the organization to ensure the peace and welfare of the family, especially the protection of the mother and children, and the education and implementation of family planning." The institution of maternity insurance is one of the legal aspects of the constitutional obligations of the State. Within the scope of this thesis, the institution of maternity insurance has been examined in detail in the context of the Turkish Social Security System.
