Abstract (EN)

The concepts of honor, dignity and self-dignity are the most fundamental values that affect the role of humans in society. Protecting these values of individuals is of great importance in ensuring social order. Turkish Armed Forces, as a community with strict rules of order; It aims to be successful in its activities by protecting the honor, dignity and esteem of those in superior positions and by strengthening the understanding of military discipline and absolute obedience. Preventing deliberate defamation acts against commanders or superiors play a key role on the path to the success of the army. For this reason, Article 85 of the Military Penal Code stipulates that those who insult their commanders or superiors will be punished. In our study, the crime of defamation against a commander or a superior will be examined by making use of the opinions in the doctrine and the jurisprudence of the current supreme court and the closed military court of cassation.
