Abstract (EN)
It is necessary to eliminate charges having equivalent effect to customs duties and measures having equivalent effect to quantitative restrictions for progressing of Customs Union which is core of European Union.It has been eliminated that charges having equivalent effect to customs duties by Article 25 EEC and measures having equivalent effect to quantitative restrictions by Article 28,29 EEC. Although, member states has been applying measures having equivalent effect because of different aims and protecting policy. Although there is no exception of implementation of charges having equivalent effect to customs duties, there is some exception of measures having equivalent effect to quantitative restrictions both indicating in Article 30 EEC and establishing by jurisprudence of ECJ. In practice problems relating to measures having equivalent effect are carrying on. It is possible to solve the problem by harmonization in European Union level. However member states behave reluctantly in this subject because of different reasons.This dissertation aims to attract attention to the measures having equivalent effect?s negative effect on free movement of goods and indicate importance of elimination of measures having equivalent effect for not only European Union but also our country which is a member of Customs Union.Key Words1.
