Abstract (EN)

Developments in international trade, technogic improvements and the changes of the description of international borders' description has brought forth new commercial concepts and precautions. Damping and anti damping are among those concepts.EU is using anti damping precautions as an important mechanism to protect its inland competition and industries. The first anti damping regulation of EU is the Council Guideline dated 22nd December 1995, number 384/96. this guideline was made to protect the internal market and competition against the cheap foreign trade goods from the countries which are not members of of the Union. thereby, the Union has been able to take specific precautions about countries of which markets are in process or countries which do not have market economy. Although some changes have been made in the gideline durin the time, main features are protected.Concerned sides are able to apply for personal protection ways by Union Courts for or agaiinst Union's taking precautions for anti-damping. Decisions made by the Union Coutrs are obligatory for sides and these decisions contributes a lot to Union anti damping law and its functioning.
