The crime of sexual harassment

The crime of sexual harassment is regulated in article 105 of the Turkish Penal Code No. 5237. According to the law, a person who sexually harasses another person is punished. In order for the crime of sexual harassment to occur, the person's bodily immunity must not be violated. In case of violation of bodily immunity, sexual assault or sexual abuse crimes may occur depending on the age of the victim. With the Law No. 6545 on the Amendment of the Turkish Penal Code and Some Laws, significant changes were made in the field of crimes against sexual immunity, including the crime of sexual harassment. In this context, it has been regulated that the victim of sexual harassment may be a child, which increases the punishment. Within the framework of this study, information about the crime of sexual harassment is given. In the first part of the study, sexual freedom, sexual violence, gender concepts, statistics on sexual harassment, and the situation of crime in comparative law are examined. In the light of judicial decisions, including the courts of appeal, current debates, the elements of the crime, its formation, qualified cases and other issues are discussed in the second and third chapters.
