Abstract (EN)
The subject of this Ph.D. thesis is sea vehicles liability insurance contract concluded under Turkish law which is derived from protection and indemnity insurances concluded under foreign laws (mostly English law) for a very long time. Currently local insurers in Turkey are also authorised to conclude such contracts under Turkish law. Accordingly, relevant secondary rules as Rulebook and Sea Vehicle Compulsory Liability Insurance General Terms and Sea Vehicle Compulsory Liability Insurance Decree are incorporated into the contract and these terms are applicable for the risks included. This thesis attempts to address the implementation of the legal rules applicable to this contract under Turkish law by examining the mentioned rules and the general rules for liability insurance under Turkish law.
