Abstract (EN)

Since its very appearance, many philosophers and authors have opiniated on the appearance of the concept of state. Whereas some authors has seen the concept as the consequence of a natural process, others have assumed it manifestation of the divine on Earth. In contravention of the absence of a consensus about the state concept, the content of notions of sovereignty, power, and legitimacy that derived from the material existence of the state has been remarkable all the time. The concept of "Reason of State" combined with state and government brought about a great revolution in the political world as soon as it was put forward. The idea that the state must be obeyed as the most important authority is prioritized, and the opinion that no rule can limit national security and interests is came to the fore. Nazi Germany was notable for its unique qualities, Hitler's march to dominance, his rise to power and the decisive implementation of his ideology were among the most important events of the previous century. The conditions and intellectual infrastructure that enabled this process led to the takeover of Germany by Nazis. This thesis analyzes this whole process and then discusses how the Nazis manipulated the law to consolidate power, eliminate and destroy the opposition. It also observes Hitler's manipulation of democracy and make legal arrangements to form a lawless but legal regime at the same time. This thesis deals with the constitution which is the considered as the foundation of the modern state and demonstrates how the Nazis defunctionalized it. In this context, the politics of NS regime in the content of Reason of State is discussed and an attempt is made to reveal the connection between Reason of State and National Socialism.
