Abstract (EN)
The Evaluation of Cyber Crimes Committed Against the State Security in Terms of Islamic Law The rapidly developing technology provides many benefits and conveniences to the everyday life of people In addition to this, besides the benefits they provided the technological developments are used as a high destructive power of element of crime for individual, society even sates. Within this scope, legal arrangements are made partially or independently in order to prevent and minimize destruction and damages that may arise through information systems. In this context, Islamic law which can produce fair, righteous and depending on science skills of the paradigm of scholars international solutions to the problems of every age with its dynamic structure, by regarding the concerns of the state, individual and society, and also, not ignoring the ijtihad (judicial opinion) method can produce criminal methods that can be applied to cyber crimes which is the most problematic kind of crime in information age against individuals' self-values the state security. In this study, the cyber crimes committed against the state security have been tried to evaluate in terms of Islamic law. In the first part, of the study after explaining the concepts related to cyber crimes, the features of cyber crimes, the ways of committing and classification of the crime and including to what extent it affects the security of the state, the concepts of cyber security and cyber terrorism were briefly mentioned, too. In the second part, of the thesis after briefly reviewing the concept of crime, the penalties against cyber crimes in modern law have been also included by applying a fiqh assessment to the cyber crimes committed against the state in terms of theft, spying, rebellion and terrorism according to Islamic criminal law. The study includes the investigation of the cyber crimes, the framework of which was drawn by modern law and which is in line with the original sources of Islamic law, and the solution oriented to this new problem occurred at the technology age by comparison of the classical methods of Islamic law and modern law.
