Abstract (EN)
Especially the technological developments in the last 30 years, particularly the influence of it in the field of trade, have increased international communication and inter-societies interaction more than ever and brought about international conflicts. Globalization, which has a great effect in every field, has also created international disputes in today's world. National courts are ineffective in resolving cross-border disputes because their jurisdiction remains within the borders of the country. In addition, the need for a quick, cheap trial that will resolve the dispute between the parties without disclosing their trade secrets and financial statements has increased. Today, Intellectual Property Rights do not remain within the borders of the country and its owner must be protected in the international arena. WIPO, as one of the specialized organizations operating within the United Nations, was established in 1967 with the Foundation Agreement of the World Intellectual Property Organization, and the WIPO Arbitration and Mediation Center within the WIPO National Bureau has been serving with alternative solutions, especially international intellectual property disputes, since 1994. In the first part of our thesis, intellectual property rights and their types and characteristics of international arbitration will be discussed. After that, in the same part, the purpose, history, structure, functioning and organs of WIPO will be examined. In the second part, the arbitration process carried out by the WIPO Arbitration and Mediation Center will be discussed and analyzed from beginning to end. In the third and last section, the termination of the arbitration proceedings, confidentiality and fees and costs will be discussed. In addition, other alternative dispute resolution methods will be briefly mentioned. In this way, WIPO will be compared with other alternative dispute resolution methods that WIPO serves around our main heading of arbitration, and will be compared with accelerated arbitration, and its advantages and its effectiveness in the international mechanism in resolving disputes in the field of intellectual property will be mentioned. In this way, an example of working in this field, especially for people in Turkey and for workers who want to do more research in this area will be eligible to be used as guidance.
