General provisions of marriage and ending of the duty of loyalty

Abstract (EN)
Main subjects of this thesis are marriage, the general effects of marriage, especially duty of loyalty in regards to general effects of marriage, the termination of the marriage in connection with the ending of the duty of loyalty within the scope of Law no. 4721 Turkic Civil Law. The family that forms the basis of the society and the marriage that constitutes its existence and the marriage unity formed during the process are very important in terms of social continuity. In this context, in the first part of our study, marriage is evaluated within the scope of positive law and doctrine by mentioning the nature and conditions of marriage. In the second chapter, the general provisions of the marriage were examined by specifically taking into consideration the loyalty obligation. In the third chapter, after discussing the connection between termination of marriage and ending of loyalty obligation, the ways to end the marriage are evaluated. As a result of the study, it was found that marriage was a reflection of the good faith to the law of marriage. In addition to this, it was evaluated that the existance of duty of loyalty is not always dependent of the existance or contuniation of the marriage especially within the last chapter. The topics which are controversial were examined one by one and our opinions and solutions about these issues were emphasized.
