International construction contracts within FIDIC framework

Abstract (EN)

In the international construction works that have been increasing rapidly in recent years, general type (standard) FIDIC contracts are used to resolve possible disputes between the parties. The FIDIC contracts are effectively implemented because there is no international court to resolve international disputes in contracts where the parties are citizens of different states, reside in different countries, or where the payments that are the subject of the contract go beyond the borders of a country. Although FIDIC contracts contain many technical details from the design stage to the construction stage, different approaches in such contracts may come to the fore depending on the knowledge and experience gained in the field of civil engineering and the developments in computer-electronic-based technical infrastructure applications in recent years. For this reason, it is thought that examining the traditional construction applications emphasized in FIDIC contracts under different technical subtitles such as geotechnical, hydraulic, mechanical, transportation, and construction materials will provide various benefits to the parties. In this context, the concept of 'contract' in Turkish Law and International Law is examined in terms of FIDIC contracts, and the results and suggestions are presented.
