Ta'wil in Islamic legal theory and its aplication in Islamic jurisprudence

Abstract (EN)

As a general term ta'wil which is the most profound one in process of formation in the field of islamic thinking, is mentioned in various disciplines such as a kalam, interpretation and islamic law. There is no doubt that ta'wil which is gained a terminological meaning to the extent of semantic shift in languages and evaluated as intellectual way of views within islamic law, played a significant role in shaping "details of fıqh". In this study necessities, provisions, varieties, principles and precise essence of ta'wil told by scholors are dealed.Also, in this study, evidences of ta'wil that is expected to find solutions to Islamic law emerged in the paralel with development of human life and gualities of interpreter and samples thay are produced by "muctehid" in respect of details of fıqh by means of ta'wil are dwelled on. Besides, academic and interpretation aspect of ta'wil and relations with other disciplines are evalvated. It has been put on emphasis on ta'wil that is used as a tool of Islamic argument in today.
