Abstract (EN)
The voluntary abandonment is an institution that prevents the punishment of the offender who has begun the execution of the crime by entering the crime. As the cause of impunity, many theories have been put forward in the historical development of the institution. The theories of crime policy appear to be acceptable, given the purpose of the institution. It is possible for the offender to give up the possibility of voluntary withdrawal at all stages of the crime. However, the process in which the cessation takes place loads different obligations to the perpetrator. In addition, the fact that the perpetrator is able to obtain impunity results in the existence of the element of volunteering.
