Abstract (EN)

Freedom of expression can be limited with purpose of protect reputation. According to article 125, Turkish Penal Code imputation, which can give damage to dignity, honour and reputation or swearing to dignity, honour and reputation is a crime. Protection of reputation is necessary but on the other hand freedom is still problem. When is a speech become to crime from right? It is a important question. Purpose of this thesis is analysing all this problems and establishing the thin line between freedom and crime. Our thesis has became different from other examination of crime types on that point. In our work, libel didn't examined as a crime type. The thesis adopts a different method which is examining the right of criticize as a reason of compliance with laws on ordinary libel. But Turkish Penal Code article 218 and 301 has been excluded. Also as much as it has similar in terms of extent the sunctions of private law has been excluded from our work.
