Abstract (EN)
The theft crime that can be defined as taking away a movable property belonging to someone else from its place in order to benefit without consent of the proprietor is involved in chapter of crimes against private property of Turkish Criminal Law.In this dissertation the theft crime is examined according to this scheme: The first chapter covers the definition of the theft crime and comparisons of similar crime types in same chapter on the code. In the next chapter, there are explanations about crime elements, qualified circumstances, sanctions that are applies against crime and its prosecutions.In the study, while explaining about the theft crime, Turkish Criminal Law No: 5237 and later modifications on this law in addition to brought amendments are mentioned. Explanations about amendments and modifications are related to both theft crime and general provisions.
