Abstract (EN)
Smart contracts, which have become widespread today with blockchain technology, are essentially a computer code. Upon the fulfillment of the conditions determined in advance in the programming language, the performance stipulated is automatically performed by the smart contract. Within the framework of the rules of the law of obligations, there are different opinions regarding the legal nature of smart contracts. While some opinions in the doctrine argue that smart contracts are only an execution method that facilitates the performance of the obligation, the opposite opinion states that smart contracts are legally binding contracts. At this point, the examination of smart contracts within the scope of the law of obligations and in comparison with the traditional contract constitutes the main subject of the study.
